Apple Sued Over Failure to Implement CSAM Detection System in iCloud

Apple is facing a lawsuit over its decision not to implement a system that would have scanned iCloud photos for child sexual abuse material (CSAM). The lawsuit, filed by a 27-year-old woman who is suing under a pseudonym, argues that Apple's inaction has forced victims to relive their trauma.

The lawsuit claims that Apple announced a "widely touted improved design aimed at protecting children" in 2021, but failed to implement the system or take any measures to detect and limit CSAM content in users' iCloud libraries. The system would have used digital signatures from the National Center for Missing and Exploited Children and other groups to detect known CSAM content.

However, Apple appeared to abandon its plans after security and privacy advocates raised concerns that the system could create a backdoor for government surveillance. The company's decision has been criticized for not doing enough to prevent the spread of CSAM on its platform.

The plaintiff in the lawsuit alleges that she was molested as an infant and that images of her were shared online. She claims that she still receives law enforcement notices nearly every day about someone being charged with possessing those images. The lawsuit seeks compensation for the plaintiff and potentially thousands of other victims.

According to attorney James Marsh, who is involved with the lawsuit, there are potentially 2,680 victims who could be entitled to compensation in this case. This is not the first time Apple has faced legal action over its handling of CSAM on iCloud. In August, a 9-year-old girl and her guardian sued Apple, accusing the company of failing to address CSAM on its platform.

In response to the lawsuit, an Apple spokesperson told The New York Times that the company is "urgently and actively innovating to combat these crimes without compromising the security and privacy of all our users." However, the company's statement does little to address the concerns of victims and advocates who argue that more needs to be done to prevent the spread of CSAM.

The lawsuit raises important questions about the responsibility of tech companies to prevent the spread of harmful content on their platforms. While Apple has taken steps to address CSAM in other areas, such as its reporting system for suspicious content, the company's decision not to implement the detection system in iCloud has been criticized for being inadequate.
